Terms and Conditions

1. Acceptance of terms

By using the Axiom Mail website or app, provided by Axiom Board Group ("we", "us"), you agree to these Terms and Conditions, our Acceptable Use Policy and our Privacy Policy. If you do not agree, please do not use the site or the app. If your company has a signed agreement with us, that agreement applies where it differs from these terms.

2. Accounts

You are responsible for keeping your sign-in details secure and for everything done under your account, including every mailing confirmed by anyone on it. The person who creates a company account is its owner and controls who else can join it. Tell us right away at [email protected] if you think your account has been used without permission.

3. Your mail

• You are responsible for what you mail and who you mail it to: the words, images, offers and addresses, and following the laws that apply to them. Your mail must follow our Acceptable Use Policy.
• A new account starts in test mode, where mailings are shown as proofs and never printed. Mail is printed only after your account is live and the mailing is confirmed by someone on your account.
• Each mailing can be cancelled for free for 15 minutes after it is confirmed, or until its scheduled date. After that it goes to print and cannot be stopped.
• Mail is printed and handed to the United States Postal Service by our printing partner. Delivery times are estimates. We are not responsible for delays, loss or damage once mail is with the Postal Service.
• We may hold or refuse a mailing that appears to break these terms or the law, and may review designs and lists to check.

4. The Mail balance and payment

• Mail is paid for in advance from your Mail balance. Each mailing is charged at the prices shown in your account when it is confirmed, and is paid from the balance before it prints.
• Deposits are at least $50, by card or bank transfer. Bank transfers can be used once they clear. Bonus credit for bank transfers, and any other promotional credit, has no cash value.
• Pieces that are cancelled, or that the Postal Service reports it could not deliver, are credited back to your balance.
• New accounts have a monthly spending limit for their first 60 days. We may change limits, and may pause an account with a payment dispute until it is resolved.
• Prices can change. A change applies to mailings confirmed after it takes effect, never to one already confirmed.

5. Unused balance and refunds

Your balance does not expire. If you close your account, we refund the unused balance you paid in, to the original payment method, about 60 days after your last mailing, so that every piece has time to be delivered or returned. Bonus and promotional credit is not refunded. Ask for a refund by closing your account in the app or by emailing [email protected].

6. Permitted and prohibited uses

You may use the site and app for lawful business purposes. You agree not to:

• Break the law or anyone's rights, including by entering information you have no right to use.
• Try to reach another company's information, or test, probe or get around our security.
• Copy, resell or reverse engineer the service, or use it to build a competing product.
• Send automated traffic that puts an unreasonable load on the service.
• Upload anything harmful, such as malware.

7. Your data

You keep ownership of the information you enter, including your designs and lists. You give us permission to store and process it, and to share it with our printing and payment partners, to provide the service, as described in our Privacy Policy. You are responsible for having the right to use your customers' information, and for honoring requests to stop mailing them.

8. Third-party services

The service relies on third-party providers for printing, postage, address checks and payments. We are not responsible for their availability or accuracy. Address checks and delivery updates come from the Postal Service and may not be complete.

9. Intellectual property

The site, the app, the starter designs, and all of their content, logos, images and copy are owned by Axiom Board Group or its licensors and are protected by law. You may use the starter designs in mail you send through Axiom Mail. These terms do not give you any right to use our name or logos.

10. Disclaimer

The site and app are provided "as is" and "as available." Estimates, including the ROI calculator and delivery dates, are not promises of results. To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation.

11. Limitation of liability

To the extent the law allows, Axiom Board Group will not be liable for any indirect, incidental, special or consequential damages, or for lost profits, revenue or data, arising from your use of the site or app. Our total liability for any claim is limited to the amount you paid us for the service in the three months before the claim.

12. Closing or suspending an account

You can close your account at any time. We may suspend or close an account that breaks these terms or the Acceptable Use Policy. If we close your account for a reason other than a breach, we refund the unused balance you paid in as described in section 5.

13. Changes to these terms

We may update these terms from time to time. The date at the top shows when they last changed. Continuing to use the site or app after a change means you accept the new terms.

14. Governing law

These terms are governed by the laws of the State of Iowa, without regard to its conflict of law rules. Any dispute will be resolved in the state or federal courts located in Iowa.
